There is so much information about substance use and abuse that finding the right resource is often time consuming and frustrating. Important Facts:  

If you or someone you know has been charged with a DUI/DWI in Washington State there are some very important issues that you should be aware of.

1) A conviction for even a first offense may result in a loss of driver's license, fines, alcohol monitoring, jail time and higher insurance premiums.

2) During an arrest for DUI the officer may punch a hole in your driver's license and will provide you with a form to request a hearing with the Department of Licensing (DOL). YOU have only 20 days to send this form in to the DOL requesting a hearing. If you do not your license may be suspended.

3) There are many confusing and often complex issues surrounding a legal charge of DUI in Washington State. If you have not already obtained legal counsel or have not been assigned a public defender, Associated Behavioral Health Care can provide you with a few attorney referrals that specialize in the area of DUI.

4)  When looking for an assessment or an evaluation make sure you do your research. A few things should always be considered:

1. Is the agency providing my assessment state certified?
2. Is the information I give confidential?
3. Does the agency offer an objective assessment?
4. Can I get an assessment done in a timely fashion?
5. Do the people I talk with to set up the assessment make me feel comfortable and at ease?
6. Are the rates for the assessment reasonable?

After talking with the staff at Associated Behavioral Health Care, you will find that the above mentioned items are in fact the standard of care at each and every location. If this is a court related issue or if your attorney is requesting that you be proactive and obtain an alcohol and drug assessment, it can be helpful to bring the following items to your assessment appointment:

2. Photo ID
3. Any and all court paperwork you might have
4. A copy of your criminal history (if applicable)
5. If you take prescription medications try to bring copies of the prescription



Please understand that none of the items are necessary to start the assessment. However at some point, if this is a court ordered issue, the court might require that we have proof of some or all of the above listed items.

When a person is arrested for DUI in Washington State they will be given a notice of a civil administrative lawsuit by the Department of Licensing.  This is a legal action that will result in the suspension of the person's driver's license, permit or privilege, if they had a breath test of 0.08 or higher (0.02 or higher for drivers under 21 years of age) or if they allegedly refused a breath test.  This suspension of the driver's license, permit or privilege to drive in Washington may affect anyone arrested, even if they have a License from another State.


You face AUTOMATIC LICENSE SUSPENSION if you fail to request a hearing and pay the hearing fee (or request a fee waiver) within 20 days of your arrest (or within 20 days of receiving notice of a blood test result.  Your license, permit or privilege to drive can be suspended for 90 DAYS, ONE  YEAR, TWO YEARS OR MORE, depending on the person's driving history and whether there is an alleged refusal to submit to the test.

There are ways to avoid the license suspension but YOU CAN NOT AVOID THE SUSPENSION IF YOU DO NOT REQUEST A HEARING WITHIN 20 DAYS.   Winning administrative suspension cases isn't easy. The rules can make it difficult for the driver.  But, while there are no guarantees, hiring an experienced attorney can improve your odds in a Washington State DUI arrest.
